AirDust Refund Policy

This refund policy explains the consumer rights that apply to AirDust under Directive 2011/83/EU on consumer rights, the Digital Content Directive (EU) 2019/770, and the Bulgarian Consumer Protection Act (Закон за защита на потребителите). It applies to the Pro upgrade — the only paid component of AirDust, a one-time purchase of €5 (no VAT â seller not VAT-registered). The Free tier is provided at no charge, and there is nothing to refund.
The Pro upgrade is digital content supplied immediately as an activation code. As explained in section 1, you keep your full 14-day right of withdrawal — if you change your mind or are not happy with Pro, ask us within 14 days and we refund you in full. Separately, and with no time limit, your statutory guarantee that the digital content conforms to the contract (section 2) always applies. Nothing in this policy is a blanket exclusion of your statutory rights.
1. Right of withdrawal — 14-day money-back guarantee
Distance contracts give EU consumers a fourteen (14) day cooling-off period under Article 9 of Directive 2011/83/EU — the right to withdraw for any reason, or no reason, and receive a full refund. For digital content that is not supplied on a tangible medium, a trader is *permitted* to ask the consumer to waive this right in exchange for immediate delivery (Article 16(m) of the Directive). AirDust does not do this. We do not ask you to give up your withdrawal right, so you keep it in full.
This means that if, within 14 days of your purchase, you change your mind or you are simply not happy with AirDust Pro, you may withdraw from the contract and we will refund your €5 in full. You do not have to give a reason.
The refund is not automatic — you exercise the right by telling us (see section 3). Any clear statement that you wish to withdraw or want a refund is enough; an email is fine. When we refund you, we revoke the activation code (section 5).
This 14-day right is separate from, and in addition to, your statutory guarantee that the digital content conforms to the contract — set out in section 2, with no time limit, applying even after the 14 days have passed.
2. Conformity guarantee for digital content (Directive (EU) 2019/770)
Independently of the withdrawal right, the AirDust Pro upgrade comes with a statutory guarantee that it conforms to the contract — that is, that the activation code works and that the Pro entitlement it unlocks functions as described. This guarantee applies independently of the 14-day withdrawal right above, has no time limit, and cannot be excluded.
If the digital content is non-conforming — for example, the activation code does not work, cannot be redeemed, or the Pro entitlement does not unlock or stops functioning through no fault of your own — you are entitled, under Directive (EU) 2019/770 (and the corresponding provisions of the Bulgarian Consumer Protection Act), to the following remedies, in order:
- Cure (bringing into conformity). The Operator will first attempt to fix the problem — for example, by re-issuing a working activation code or correcting the backend so the Pro entitlement is restored — within a reasonable time and free of charge.
- Price reduction or refund. If cure is impossible, fails, is not provided within a reasonable time, or would cause you significant inconvenience, you are entitled to a proportionate price reduction or to terminate the contract for a full refund of the €5 (no VAT â seller not VAT-registered). For a one-time €5 unlock, a refund in full is the normal outcome where a working code cannot be provided.
There is no blanket "no refunds" rule: a non-working or non-conforming Pro purchase is always refundable under this conformity guarantee, regardless of how much time has passed since purchase. To claim a remedy, email airdust.app@gmail.com describing the problem and including your PayPal transaction ID or activation code.
3. How to request a remedy or goodwill refund
To raise a conformity problem or to request a goodwill refund, reply to the activation email you received from the Operator, or email airdust.app@gmail.com directly, and describe the issue in plain text. Any unambiguous statement is acceptable; you do not need to use a particular form of words. Please include your PayPal transaction ID or activation code so the Operator can locate your purchase.
4. What is returned
Where a refund is due — whether under the conformity guarantee (section 2) or as a goodwill gesture — the Operator refunds the full purchase price of the Pro upgrade — five Euro (€5) — using the same payment method you used for the original transaction (PayPal). Refunds are issued without undue delay and in any event no later than fourteen (14) days from the day the Operator agreed that a refund is due.
You receive the full amount you paid. No part of the refund is withheld for fulfilment, email delivery, or processing costs; any payment-processing cost is borne by the Operator, not deducted from your refund.
5. What happens to the activation code
When the refund is issued, the Operator revokes the activation code. For a PayPal purchase the payment is refunded in full through PayPal and the code is revoked together; codes issued by other means are revoked the same way. Revocation has the following effect:
- The code can no longer be redeemed by anyone (including a different device).
- The authentication token issued to your device — if the code was already redeemed — is treated as revoked on the device's next request to the Backend, which causes the device to fall back to the Free tier on its next refresh cycle.
- Pro features that were available to you while the code was active stop working when the device next syncs with the Backend.
You are not required to uninstall the widget or take any action on your device for the revocation to take effect; the Free tier continues to work normally.
6. Goodwill refunds and limitations
The conformity guarantee in section 2 applies whenever the Pro upgrade is non-conforming, with no time limit. The 14-day money-back right in section 1 covers a change of mind within 14 days of purchase. Separately and beyond both of those, where the Pro upgrade did work as described and the 14-day window has passed, the Operator may at its sole discretion offer a refund as a goodwill gesture — for example, where you can no longer use the watch the Pro licence was bound to. Such goodwill refunds are not a contractual right.
The Operator may decline a goodwill refund in the case of demonstrable abuse — for example, where the same payer has repeatedly purchased and refunded multiple activation codes in a pattern incompatible with good-faith use. This abuse exception does not apply to, and cannot be used to refuse, a genuine conformity remedy under section 2. In any case where the Operator declines a request, it will set out the reasons in writing.
7. Disputes and dispute resolution
If you are not satisfied with how a request was handled, you may:
- Contact the Operator in writing at airdust.app@gmail.com to request a written response.
- Lodge a complaint with the Bulgarian Consumer Protection Commission (Комисия за защита на потребителите) at https://kzp.bg, or with the consumer-protection body in your own country of residence. For data-protection matters, you may complain to the Bulgarian Commission for Personal Data Protection (Комисия за защита на личните данни) at https://www.cpdp.bg.
- Bring proceedings before the competent courts of Sofia, Bulgaria, or the courts of your habitual residence (where consumer law gives you that option).
Alternative dispute resolution (ADR): the Operator is not currently committed to, and does not undertake to use, any specific alternative dispute resolution entity for consumer disputes. You remain free to use any ADR body that is competent for your dispute, and to use the complaint routes above. (Note: the EU Online Dispute Resolution platform was shut down on 20 July 2025 and is no longer available.)
