AirDust Terms of Service

These Terms of Service ("Terms") govern your use of the AirDust Connect IQ widget and the associated backend service (together, the "Service"), operated by Ivaylo Minkov, Sofia, Bulgaria ("Operator", "we", "us"). By installing the widget, redeeming an activation code, or otherwise using the Service, you ("you", "User") agree to these Terms.

1. The Service

AirDust displays real-time particulate-matter air-quality readings (PM2.5 and PM10) sourced from the Sensor.Community network on a Garmin Connect IQ-compatible device. The Service is offered in two tiers:

2. License Grant

2.1 Free tier

Subject to these Terms, the Operator grants you a worldwide, royalty-free, non-exclusive, revocable, non-transferable licence to install and use the Free tier of the AirDust widget on any Garmin device you own or control, for personal, non-commercial use.

2.2 Pro tier

Each activation code grants a single Pro licence: one (1) Garmin device, one (1) end user, perpetual, non-transferable, non-sublicensable. The licence is bound to the device identifier supplied by Garmin Connect IQ at activation. Moving the licence to a different device requires the Operator to revoke the original code and issue a new one at the Operator's discretion (typically free of charge for a verified hardware change such as a watch replacement under warranty).

The Operator may revoke an activation code at any time if it has reasonable evidence the code was obtained or used in breach of these restrictions. Revocation invalidates the corresponding authentication token on the next request to the Backend.

3. Fees and Payment

3.1 Pro upgrade price

The Pro tier is offered as a one-time purchase at the price advertised on the checkout page and in the Connect IQ store listing at the time of order (currently five Euro / €5 per device). The price shown at checkout is the total price payable. The Operator is a sole trader not registered for VAT, so no VAT is added.

3.2 Payment processor

Payment is processed externally via PayPal (Europe) S.à r.l. & Cie, S.C.A. The Operator does not collect or store payment-card data; the Operator receives only the information PayPal passes through (payer email, transaction amount, free-text note). Payment is governed by PayPal's terms; refer to https://www.paypal.com/legalhub for details.

3.3 Manual code issuance and SLA

After payment, the Operator issues an activation code by email within a target service level of twenty-four (24) hours from receipt of payment. Code issuance may be delayed by external factors (PayPal review holds, Resend deliverability issues, operator availability); in any such case the Operator will notify you and either issue the code as soon as possible or refund the payment.

3.4 Currency, language, and supplier identification

All transactions are denominated in Euro (EUR). The Operator's contractual language is English (these Terms) with Bulgarian as the language of the underlying obligation. The Operator is identifiable for consumer purposes as: Ivaylo Minkov, Sofia, Bulgaria, airdust.app@gmail.com.

4. Refund Policy

EU consumers have a 14-day cooling-off period for distance contracts under Article 9 of Directive 2011/83/EU on consumer rights, transposed in Bulgaria via the Consumer Protection Act. Although the Pro tier is digital content made available immediately — which would let the Operator ask you to waive this right under Article 16(m) of the Directive — the Operator does not ask you to waive it. You keep your full 14-day right of withdrawal: if, within 14 days of purchase, you change your mind or are not happy with Pro, you may withdraw and receive a full refund of the €5, without giving a reason. The right is exercised by telling the Operator (an email to airdust.app@gmail.com is enough); it is not automatic. On withdrawal the Operator refunds you in full and revokes the activation code.

4.1 Your statutory conformity guarantee also applies

Beyond the 14-day withdrawal right above, these Terms do not impose a blanket "no refunds" rule. Your statutory rights for non-conforming or undelivered digital content under Directive (EU) 2019/770 on digital content and digital services (transposed in Bulgaria) are unaffected and apply with no time limit. If the Pro tier is not delivered, or does not conform to what was agreed (for example, the activation code does not work or a Pro feature is materially defective), you are entitled to have it brought into conformity (cure) and, where cure is impossible, refused, or not carried out within a reasonable time, to a proportionate price reduction or a refund, in accordance with that Directive. Nothing in these Terms excludes, limits, or waives that guarantee.

5. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF SENSOR, POLLEN, UV OR AIR-QUALITY-INDEX DATA, OR UNINTERRUPTED OPERATION.

In particular, the Operator does not warrant that:

This disclaimer does not exclude or limit any consumer right that cannot be excluded under Bulgarian or EU law.

6. Limitation of Liability

To the maximum extent permitted by law, the Operator's aggregate liability for all claims arising out of or relating to the Service is limited to the greater of:

The Operator is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or loss of goodwill, even if advised of the possibility.

This limitation does not apply to: (a) liability for death or personal injury caused by the Operator's negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be limited or excluded under Bulgarian or EU consumer law.

7. Termination

You may stop using the Service at any time by uninstalling the widget from your Garmin device. The Operator may terminate or suspend your access — including by revoking your activation code — if you breach these Terms, in particular Section 2.3. The disclaimers, limitations of liability, and dispute-resolution provisions survive termination.

8. Privacy

The Operator's processing of personal data in connection with the Service is described in privacy-policy.md, which forms part of these Terms by reference.

9. Intellectual Property

The AirDust widget and the Backend are proprietary software. All rights in and to the widget, the Backend, the "AirDust" name and logo, and the Service are reserved by the Operator. AirDust is not open-source software: the Pro tier is a licensed, perpetual unlock granted on the terms set out in Section 2, not a transfer of ownership or of the source code. Except for the licence expressly granted in Section 2 (and the limited reverse-engineering carve-out in Section 2.3 permitted under Article 6 of Directive 2009/24/EC), these Terms do not grant you any right to copy, modify, distribute, or create derivative works of the widget or the Backend. They likewise do not grant you any right to use the "AirDust" name or logo as used by the Operator, except as permitted by applicable law (for example, nominative fair use to refer to the Service).

9.1 Third-party data attribution

The Service incorporates data from third parties under their respective licences, and you agree to preserve these attributions:

These attributions are also surfaced in the widget and on the Backend. Use of these data sources does not imply any endorsement of AirDust by the respective providers.

10. Changes to These Terms

The Operator may amend these Terms by publishing a revised version at the URL where these Terms are hosted. Material changes will be announced in the widget's changelog and on the Connect IQ store listing at least thirty (30) days before taking effect. Continued use of the Service after the effective date constitutes acceptance.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict-of-laws rules. The mandatory consumer-protection provisions of the country where you reside (if more favourable to you) continue to apply.

Disputes shall be submitted to the competent courts of Sofia, Bulgaria. Nothing in this Section affects your right as a consumer to bring proceedings in the courts of your country of residence, or to refer a dispute to a competent national consumer alternative-dispute-resolution (ADR) body.

Alternative dispute resolution. The Operator is not currently committed to, and does not undertake to use, any specific ADR entity for the resolution of consumer disputes. This does not affect your own right to use ADR where it is available to you. If you have a complaint you cannot resolve with the Operator directly (airdust.app@gmail.com), you may approach the Bulgarian Consumer Protection Commission (Комисия за защита на потребителите) on consumer matters, and the Commission for Personal Data Protection (Комисия за защита на личните данни / CPDP) on personal-data matters, as further described in privacy-policy.md. (The European Commission's Online Dispute Resolution platform was discontinued on 20 July 2025 and is therefore no longer referenced or linked here.)
